1) Acceptance of Terms

These Terms & Conditions of Use (“Terms”) are legally binding. By accessing beautyrefined.us, booking services (in-person or telehealth), purchasing products, or interacting with Beauty Refined, LLC (“Beauty Refined,” “we,” “us,” “our”), you agree to these Terms and to our Privacy Policy.

  • Age: You must be at least 16 to use the site and 18 to purchase services/products or receive telehealth care (or have a parent/guardian’s written consent where permitted by law).

  • We may update these Terms at any time. Continued use means you accept the updated Terms.

2) Company & Jurisdiction

This website is owned and operated by Beauty Refined, LLC, based in Orlando, Florida, USA.

  • Governing Law / Venue: Florida law governs these Terms. Any dispute shall be brought exclusively in the state or federal courts located in Orange County, Florida.

3) Intellectual Property

All content (text, designs, images, logos, videos, graphics, trademarks, look-and-feel) is owned by Beauty Refined or used with permission. You may not copy, reproduce, distribute, modify, or create derivative works without prior written consent. Limited, revocable viewing for personal, non-commercial use is permitted.

4) Security, Accounts & Assumption of Risk

  • You’re responsible for safeguarding any account credentials.

  • We use reputable hosts and reasonable safeguards, but no system is 100% secure. You use the site and transmit data at your own risk.

  • Unencrypted email, SMS, or social DMs may not be secure—limit sensitive information to our HIPAA-enabled channels when requested.

5) Payments & Processors

Payments are processed by PayPal and Authorize.Net. By purchasing, you authorize us to charge your selected method. We do not store full card details. You are responsible for any bank/processor fees and for providing accurate, current payment info.

6) Services, Education & Medical Disclaimer

  • Content on the site (blogs, guides, videos, social media) is educational/informational and not a substitute for in-person evaluation by a qualified clinician.

  • No outcomes are guaranteed. Individual results vary. Always seek personal medical, legal, tax, or financial advice from licensed professionals.

7) Telehealth Terms (Read Carefully)

By booking or receiving telehealth services with Beauty Refined, you acknowledge and agree:

7.1 Nature & Limitations

  • Telehealth involves the remote delivery of health services via secure audio/video, chat, portals, or electronic exchange of information (including photos).

  • Telehealth has limitations: your clinician may not visualize or examine all aspects as in person; we may request in-person follow-up, labs, imaging, or referral as appropriate.

  • Telehealth may not be appropriate for all conditions; we may decline care if remote care is unsafe or clinically inappropriate.

7.2 Technology Risks

  • Telehealth may experience failures or delays due to internet/technology issues (interruptions, poor video quality, data loss).

  • You are responsible for providing accurate history, current medications, allergies, and high-quality images when requested.

7.3 Privacy & HIPAA

  • We use reasonable safeguards to protect your Protected Health Information (PHI) under HIPAA.

  • Despite safeguards, no transmission is risk-free. Avoid using public Wi-Fi and ensure you’re in a private space for sessions.

  • See our Privacy Policy for details. We do not sell PHI.

7.4 Emergencies

  • Telehealth is not for emergencies. If you have severe or alarming symptoms (e.g., chest pain, severe shortness of breath, anaphylaxis, stroke symptoms, suicidal ideation), call 911 or go to the nearest emergency department first.

7.5 Consent & Availability

  • By commencing a telehealth visit, you provide informed consent to telehealth, including its risks and limitations.

  • Telehealth eligibility may depend on your location at the time of service and clinician licensure; you must truthfully disclose your location.

8) Communications & Content You Submit

  • Communications through contact forms, blog comments, social media, or email are not confidential unless we expressly state otherwise or a separate patient agreement applies.

  • You agree not to submit unlawful, defamatory, obscene, harassing, or infringing material. We may remove or refuse content at our discretion.

  • We may reuse non-PHI user content (e.g., public comments/testimonials you authorize) in our marketing, with attribution where feasible.

9) Third-Party Links & Tools

We may link to third-party sites or offer embedded tools (e.g., payment gateways). We are not responsible for third-party content, availability, or practices. Review their terms and privacy policies before use.

10) Warranties Disclaimer

THE WEBSITE, CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, uptime, and error-free operation.

11) Limitation of Liability

To the fullest extent permitted by law, Beauty Refined, LLC and its owners, clinicians, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; data loss; service interruptions; or errors/omissions, even if advised of the possibility.
Our total liability for any claim shall not exceed the amount you paid to us for the specific product/service giving rise to the claim.

12) Indemnification

You agree to defend, indemnify, and hold harmless Beauty Refined, LLC and its owners, clinicians, employees, and contractors from any claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (a) breach of these Terms; (b) misuse of the site, services, or telehealth; (c) violation of law or third-party rights.

13) Refunds, Returns & Scheduling

All sales are final per our Refund & Returns Policy. Medical/prescription items cannot be returned or refunded once dispensed or shipped. Missed or late arrivals may forfeit fees/deposits per our scheduling policies.

14) Affiliates & Sponsored Content

From time to time, we may use affiliate links or accept sponsored content. We disclose material connections where required. You assume all risk for purchases through third-party links.

15) Termination

We may suspend or terminate access to the site, services, or telehealth at any time for policy violations, suspected fraud, or risks to safety or compliance. Sections intended to survive (IP, disclaimers, limitations, indemnity, governing law) do survive termination.

16) Entire Agreement

These Terms, together with our Privacy Policy and any informed consent(s) or service-specific agreements (including telehealth consent and treatment consent), constitute the entire agreement between you and Beauty Refined and supersede all prior discussions.

17) Severability

If any provision is found unenforceable, the remainder remains in full force and effect.
