Welcome to Beauty Refined, LLC (“Beauty Refined,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Beauty Refined website, online services, telehealth services, treatment programs, ShopRx services, communications, and other services offered by Beauty Refined.

By accessing or using the website, submitting information, requesting treatment, creating an account, completing checkout, making a payment, or receiving services from Beauty Refined, you acknowledge that you have read, understood, and agree to these Terms.

1. Nature of Services

Beauty Refined operates a telehealth medical practice and provides healthcare services, wellness services, medical evaluations, treatment programs, and access to prescription treatments when clinically appropriate and legally permitted.

Beauty Refined may also offer non-prescription products, skincare products, supplements, educational materials, and other wellness-related products or services.

Certain treatments displayed on the website may involve prescription medications or compounded medications that require an individualized medical evaluation, authorization by an appropriately licensed healthcare provider, a valid prescription, and fulfillment by an appropriately licensed dispensing pharmacy.

The display of a treatment, medication, compounded preparation, product name, price, description, or other information on the website does not guarantee eligibility for treatment, issuance of a prescription, availability of a medication, or pharmacy fulfillment.

2. Eligibility to Use Our Services

You must be at least 18 years old to independently request prescription treatment through Beauty Refined unless a particular service is expressly offered to a minor in compliance with applicable law and appropriate parent or legal guardian authorization.

You agree to provide complete, accurate, current, and truthful information when using Beauty Refined’s website and healthcare services.

You may not use another person’s identity, submit false medical information, conceal relevant medical information, falsify your location, provide misleading information to a healthcare provider, or otherwise misuse Beauty Refined’s services.

Beauty Refined may decline, suspend, or terminate access to services when permitted by applicable law if false information, fraud, misuse, abusive conduct, payment fraud, or violations of these Terms are identified.

3. No Emergency Medical Services

Beauty Refined does not provide emergency medical services.

The website, telehealth services, electronic forms, messaging services, and other Beauty Refined services should not be used for medical emergencies.

If you believe you are experiencing a medical emergency, call 911 or seek immediate care at the nearest emergency department.

4. General Website Information Is Not Medical Advice

General information provided through the Beauty Refined website, product descriptions, educational materials, social media, emails, text messages, advertisements, and other public communications is provided for informational and educational purposes only.

General website content does not constitute individualized medical advice, diagnosis, treatment, or a prescription.

Medical advice and treatment recommendations are provided only through an appropriate healthcare relationship and after completion of the medical evaluation process required for the applicable service.

5. Telehealth Services

Telehealth involves the delivery of healthcare services through electronic communications and healthcare technologies.

Telehealth services may include secure electronic forms, medical questionnaires, patient portals, laboratory records, photographs, medical records, electronic messaging, telephone communication, audio or video communication, and other technology appropriate for providing healthcare services.

Telehealth has limitations and may not be appropriate for every patient, condition, or requested treatment.

Beauty Refined and its healthcare providers may require additional information, medical records, laboratory testing, photographs, synchronous communication, an in-person examination, referral to another healthcare professional, or other clinical requirements when medically appropriate or legally required.

Beauty Refined may decline to provide treatment when telehealth is clinically inappropriate or when applicable legal, professional, prescribing, pharmacy, or jurisdictional requirements cannot be satisfied.

6. Patient Responsibilities

Patients are responsible for providing complete, accurate, and truthful information, including:

  • Identity and contact information;

  • Date of birth;

  • State of residence;

  • Physical location when healthcare services are provided;

  • Medical history;

  • Current and past medical conditions;

  • Medications and supplements;

  • Allergies;

  • Pregnancy or breastfeeding status when relevant;

  • Laboratory results and medical records when requested;

  • Prior treatments and adverse reactions;

  • Contraindications and risk factors; and

  • Any other information reasonably requested by the treating healthcare provider.

Patients are responsible for updating Beauty Refined and their healthcare provider when relevant medical information changes.

Failure to provide required information or providing false, incomplete, or misleading information may result in delay, denial, cancellation, or termination of healthcare services when permitted by applicable law.

7. Prescription Treatment Requests and Online Ordering Process

7.1 Prescription Products Are Not Available for Unrestricted Public Purchase

Certain prescription treatments, compounded medications, and treatment programs may be displayed through the Beauty Refined website and ShopRx section.

The display of a prescription medication, compounded preparation, treatment program, price, or “Add to Cart” functionality does not mean that prescription medication is available for unrestricted purchase by the general public.

Prescription medications are not prescribed, dispensed, or shipped solely because a website visitor selects a product, adds an item to a shopping cart, submits an order, or completes payment.

All prescription treatment requests are subject to completion of required medical forms and consents, provider review, clinical approval, provider licensure requirements, pharmacy acceptance, pharmacy licensure requirements, jurisdictional restrictions, and applicable law.

7.2 Website Checkout Is a Request for Treatment

Adding a prescription treatment to the shopping cart, submitting an order, providing payment information, or completing checkout constitutes a request to be evaluated for the selected treatment or treatment program.

A website transaction does not constitute the purchase of a prescription medication, does not constitute a medical evaluation, does not create an automatic right to receive treatment, does not constitute provider approval, and does not result in the automatic issuance of a prescription or dispensing of medication.

Payment does not obligate a healthcare provider to prescribe any medication.

7.3 Required Medical Intake Forms and Consents

Patients requesting prescription treatment must complete all required medical intake forms, health history questionnaires, identity and location information, telehealth consents, treatment-specific informed consent forms, and other documentation required for the requested treatment.

Beauty Refined uses secure electronic healthcare forms and technology platforms, including Jotform, to collect medical intake information, patient consents, laboratory information, and supporting clinical documentation.

Required forms and consents must be completed before a prescription medication may be authorized for pharmacy fulfillment.

Submission of forms or consent documents does not guarantee approval for treatment.

If required medical intake forms, consents, or requested clinical documentation are not completed, the order will not proceed to prescription fulfillment.

7.4 Independent Provider Review

Every request for prescription treatment is subject to independent review by an appropriately licensed healthcare provider.

The provider may review the patient’s medical history, intake responses, requested treatment, current medications, allergies, contraindications, laboratory results when clinically required, prior treatments, and other relevant clinical information.

The provider may request additional information, medical records, laboratory testing, photographs, synchronous communication, an in-person examination, or referral to another healthcare professional when medically appropriate or legally required.

The provider independently determines whether treatment is medically appropriate.

A prescription is issued only when the provider determines that treatment is clinically appropriate and may lawfully be prescribed to the patient.

Payment, checkout, submission of an order, or completion of medical forms does not require or obligate a provider to issue a prescription.

7.5 Patient Location and Provider Licensure

Patients must accurately disclose their state of residence and physical location when receiving telehealth healthcare services.

Prescription treatment may be provided only when the treating healthcare provider is appropriately licensed or otherwise legally authorized to evaluate, treat, and prescribe, when applicable, in the jurisdiction where the patient is located.

Beauty Refined does not authorize prescription treatment when applicable provider licensure or jurisdictional requirements cannot be satisfied.

Patients may be required to verify identity, residence, or physical location.

7.6 Prescription Issuance and Pharmacy Fulfillment

Beauty Refined does not manufacture or compound prescription medications and does not directly dispense prescription medications to patients.

When an appropriately licensed healthcare provider determines that treatment is medically appropriate and all applicable requirements have been satisfied, the provider may issue a patient-specific prescription and transmit it to an appropriately licensed dispensing pharmacy.

The dispensing pharmacy independently determines whether it may lawfully accept the prescription and compound, dispense, and ship the prescribed medication to the patient’s jurisdiction.

The pharmacy may request additional information, decline a prescription, or refuse fulfillment when applicable clinical, legal, licensing, regulatory, or operational requirements cannot be satisfied.

Issuance of a prescription does not guarantee pharmacy fulfillment.

No prescription medication is released for pharmacy fulfillment solely because a patient has completed checkout or submitted payment.

7.7 Orders That Cannot Proceed to Treatment or Fulfillment

Prescription medication will not be prescribed, dispensed, or shipped when:

  • Required medical intake forms or consents are not completed;

  • Requested medical records, laboratory results, or other required clinical information are not provided;

  • The healthcare provider determines that treatment is not medically appropriate;

  • An appropriately licensed healthcare provider is unavailable for the patient’s jurisdiction;

  • Applicable telehealth or prescribing requirements cannot be satisfied;

  • The dispensing pharmacy cannot lawfully dispense or ship the prescribed medication to the patient’s jurisdiction;

  • The dispensing pharmacy declines to accept or fulfill the prescription; or

  • Another applicable legal, clinical, regulatory, or operational requirement prevents treatment or fulfillment.

When an order cannot proceed to treatment or lawful fulfillment, the order will be canceled and refunded in accordance with the ShopRx, Prescription Treatment, Payment, Refund & Fulfillment Policy and applicable law.

8. Payments

Prices for treatment programs, healthcare services, medical evaluations, prescription coordination services, retail products, and other services may be displayed on the website.

Beauty Refined may collect payment before completion of provider review.

When payment is collected before completion of the medical evaluation process, payment is collected in connection with the patient’s request for evaluation and, if approved, participation in the applicable treatment program and receipt of the services described at checkout.

Payment does not constitute the purchase of an automatically issued prescription and does not guarantee that medication will be prescribed, compounded, dispensed, or shipped.

No prescription is issued solely because payment has been submitted.

Payments are processed through third-party payment processors identified at checkout.

Beauty Refined does not store complete payment card information.

9. Cancellations and Refunds

Prescription treatment requests remain subject to completion of required medical intake forms and consents, provider review and approval, provider licensure requirements, pharmacy acceptance, pharmacy jurisdictional requirements, and applicable law.

If required forms are not completed, the patient is not approved for treatment, applicable jurisdictional requirements cannot be satisfied, the dispensing pharmacy cannot lawfully fulfill the prescription, or another legal or clinical requirement prevents treatment, prescription medication will not be dispensed and the order will be canceled and refunded in accordance with the ShopRx, Prescription Treatment, Payment, Refund & Fulfillment Policy.

Once a prescription has been accepted for fulfillment, a patient-specific compounded medication has begun preparation, or medication has been dispensed or shipped, cancellation or refund may no longer be available except when required by law or when Beauty Refined or the dispensing pharmacy determines that a verified dispensing error, product defect, shipping issue, or other circumstance warrants corrective action.

Any separately disclosed and earned medical evaluation, consultation, laboratory, administrative, or other service fees may be non-refundable when permitted by applicable law and clearly disclosed to the patient before payment.

10. Compounded Medications

Certain treatments offered through Beauty Refined may involve compounded medications.

Compounded medications are not FDA-approved drug products. The FDA does not review compounded medications for safety, effectiveness, or manufacturing quality before they are marketed.

A compounded medication is prescribed only when the treating healthcare provider determines that it is medically appropriate for the individual patient and may lawfully be prescribed.

Availability of a particular compounded medication, active ingredient, formulation, dosage, or pharmacy may change based on clinical judgment, pharmacy capabilities, ingredient availability, applicable law, regulatory requirements, and the patient’s jurisdiction.

Beauty Refined does not guarantee the continued availability of any particular compounded medication or formulation.

11. Prescription Medication Risks and Patient Consent

Prescription medications and compounded medications may involve risks, side effects, contraindications, drug interactions, and other potential adverse outcomes.

Patients are responsible for reviewing treatment information, completing required informed consent documents, following provider instructions, using medications only as prescribed, and promptly reporting adverse reactions or significant changes in health status.

Patients should seek immediate medical care for serious or emergency symptoms.

12. Pharmacy and Shipping

Prescription medications are fulfilled and shipped by dispensing pharmacies or their authorized fulfillment partners.

Shipping and delivery estimates are not guaranteed.

Delays may occur due to provider review, prescription processing, pharmacy review, medication preparation, weather, carrier delays, holidays, patient availability, address errors, or other circumstances.

Patients are responsible for providing accurate shipping information.

Patients should promptly contact Beauty Refined regarding damaged shipments, incorrect medications, suspected dispensing errors, temperature concerns, lost packages, or other fulfillment issues so the matter can be reviewed with the dispensing pharmacy and carrier.

13. Retail and Non-Prescription Products

Beauty Refined may offer skincare products, supplements, educational materials, and other non-prescription products.

Purchase of non-prescription products does not require provider approval unless otherwise stated.

Return, refund, cancellation, and shipping terms applicable to non-prescription products are described in the Shop Policy or on the applicable product page.

14. Communications Consent

By providing your contact information, you authorize Beauty Refined to communicate with you regarding treatment requests, appointments, forms, consents, laboratory testing, prescriptions, pharmacy fulfillment, payments, shipping, customer service, account matters, and other healthcare or business communications.

Communications may occur by telephone, email, text message, secure electronic forms, patient portals, or other communication methods.

Standard message and data rates may apply.

Patients should avoid transmitting sensitive medical information through unsecured communication channels.

Marketing communications will be sent in accordance with applicable law and any required consent or opt-out requirements.

15. Privacy and Health Information

Beauty Refined collects, uses, maintains, and discloses personal information and health information as described in the Beauty Refined Privacy Policy and applicable healthcare privacy notices.

Beauty Refined uses reasonable administrative, technical, and physical safeguards designed to protect personal information and health information.

When Beauty Refined is subject to HIPAA or other healthcare privacy laws with respect to particular information or activities, Beauty Refined handles Protected Health Information in accordance with applicable requirements.

16. Intellectual Property

The Beauty Refined website and its original content, branding, graphics, logos, text, treatment program names, educational materials, photographs, videos, designs, and other materials are owned by Beauty Refined or used with permission and are protected by applicable intellectual property laws.

Users may not copy, reproduce, distribute, modify, republish, sell, exploit, or create derivative works from Beauty Refined content without prior written permission except as permitted by law.

17. Prohibited Uses

You may not use the Beauty Refined website or services to:

  • Provide false or fraudulent information;

  • Misrepresent your identity, age, residence, or physical location;

  • Obtain prescription medication for another person;

  • Resell, redistribute, or transfer prescription medication;

  • Obtain medication through fraud, deception, or material omission;

  • Interfere with website security or operations;

  • Attempt unauthorized access to systems or patient information;

  • Upload malicious software or harmful content;

  • Violate applicable law;

  • Harass or abuse Beauty Refined personnel, providers, pharmacies, or other users; or

  • Use Beauty Refined content or services for unauthorized commercial purposes.

18. Suspension or Termination of Services

Beauty Refined may decline, suspend, restrict, or terminate website access, treatment requests, or services when permitted by applicable law due to fraud, misuse, threats, abusive conduct, repeated policy violations, failure to provide required information, nonpayment, or other legitimate reasons.

Termination of an established healthcare relationship will be handled in accordance with applicable professional and legal obligations.

19. Third-Party Services

Beauty Refined may use or link to third-party services, including electronic form providers, laboratories, pharmacies, payment processors, website platforms, communication services, and other technology providers.

Beauty Refined is not responsible for the independent acts, omissions, availability, privacy practices, or terms of third-party services except as required by applicable law.

Use of third-party services may be subject to separate terms and privacy policies.

20. No Guarantee of Treatment Approval or Results

Beauty Refined does not guarantee that a patient will qualify for treatment, receive a prescription, receive a specific medication or formulation, obtain pharmacy fulfillment, lose a specific amount of weight, achieve a particular hormone level, experience symptom improvement, or obtain any other particular clinical result.

Healthcare outcomes vary between individuals.

Healthcare providers retain independent professional judgment regarding all medical evaluations, diagnoses, treatment recommendations, and prescribing decisions.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Beauty Refined will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website, inability to access the website, or use of non-medical website content.

Nothing in these Terms is intended to waive, disclaim, or limit any liability that cannot lawfully be waived, disclaimed, or limited.

Nothing in these Terms limits a patient’s rights or remedies under applicable healthcare, consumer protection, privacy, or other law.

22. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold Beauty Refined harmless from claims, damages, losses, or expenses arising from fraudulent conduct, intentional misuse of the website or services, unlawful resale or transfer of prescription medication, violation of these Terms, or violation of the rights of another person.

This provision does not require a patient to indemnify Beauty Refined for Beauty Refined’s own professional negligence, unlawful conduct, or other liability that cannot lawfully be transferred to the patient.

23. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except when another jurisdiction’s laws apply to healthcare services provided to a patient located in that jurisdiction.

Any dispute concerning healthcare services, privacy rights, consumer rights, or other matters subject to mandatory law will be handled in accordance with applicable law.

24. Changes to These Terms

Beauty Refined may update these Terms periodically to reflect changes in services, website operations, clinical workflows, technology, pharmacy relationships, regulatory requirements, or applicable law.

Updated Terms will be posted on the website with a revised “Last Updated” date.

Continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
